Our experience covers all phases of a project, including pre-engineering, bidding, engineering, procurement and fabrication, construction and installation, through commissioning and commercial operation of the facilities. 


Power Generation and Transmission

One of the most important sectors in infrastructure projects is power generation and transmission. It is characterized by the involvement of public entities and the complex participation of different disciplines such as civil, mechanical, electrical, I&C, telecommunications, etc. The major challenges in these projects consist of the complex coordination of interfaces between these disciplines and the management of highly compressed schedules, combined with managing situations that are difficult to foresee, such as adverse subsurface conditions. Four-C has participated as a consultant or expert in projects for hydroelectric plants, conventional thermal plants of all types, nuclear plants, wind farms, and solar parks, as well as transmission lines and substations.


Oil and Gas

This sector is divided into offshore projects, which include extraction platforms and offshore pipelines, and onshore projects, which include refineries, gas or oil pipelines, pumping stations, sales terminals, and regasification plants. These projects face the challenge of achieving very high environmental and safety standards, as well as, in the case of pipelines, obtaining rights-of-way and dealing with unpredictable subsurface conditions, which frequently leads to loss of productivity, delays, and disputes over excusability and compensability.

Factories and Industrial Plants

This type of private initiative projects are characterized by greater flexibility in the management of disputes, which often leads to untimely claims and an accumulation of unresolved disputes that are difficult to reconcile. The frequent intervention of the owner in the execution of the works creates unclear situations in the assignment of responsibilities and contractual rights. Four-C's interventions in the early phases of this type of project have helped find timely solutions and avoid lengthy and costly arbitration processes. As experts, we have assisted arbitrators in obtaining clarity on highly complex technical issues.


Roads, Tunnels and Bridges

As in power generation and transmission, this sector normally involves public entities, which means high formal requirements and little flexibility in the search for negotiated dispute resolutions. In the case of roads, rights-of-way are a frequent problem, and in tunnels, subsurface conditions create very special challenges. Four-C has participated as an expert in Arbitration processes, Dispute Boards, and ad hoc Expert Determinations, both for contractors and owners, helping them resolve their disagreements.


Transportation Systems and Airports

We have participated in supporting companies that have developed construction projects for metropolitan electric transportation systems, ports, and airport remodeling, providing consulting services in contract management, as well as dispute resolution (from the analysis of potential claims to expert opinions in arbitration proceedings).


Communal Infrastructure

Without a doubt, communal infrastructure is a very important objective of construction contracts where both national and international organizations participate, whose ultimate goal is to provide services to the community. We have participated by providing support to the parties in resolving arbitrations involving at least the construction of a hospital and an aqueduct in Central America.


Mining

The extraction of resources through mining is another sector of the industry that also requires developing construction projects, whose contracts are sometimes also a source of disputes. Building

The claiming party often hesitates to initiate proceedings because they think this would damage their relationship with the Client or counterparty. The truth is the opposite: what damages relationships is precisely the accumulation of disputed issues that become increasingly difficult to reconcile. 

That is why Four-C places its focus on resolving such disputes as quickly as possible. Four-C can accompany the parties in the search for alternative solutions to the judicial framework, actively participating in processes of:

Dependiendo de los resultados de un anรกlisis inicial (assessment) de los procesos existentes Four-C desarrollarรก los procesos, procedimientos o lineamientos necesarios, para que todo el equipo participe, segรบn su rol en el proyecto, en la detecciรณn, notificaciรณn y cuantificaciรณn oportuna de cualquier situaciรณn de cambio, lo cual es esencial para evitar la escalaciรณn de controversias y para mantener las buenas relaciones entre las partes. 


CM Coaching

La forma mรกs efectiva y econรณmica de la implementaciรณn de procesos profesionales de CM es combinar las actividades del dรญa a dรญa de un Contract Manager interno con una supervisiรณn externa de un experto, quien garantiza con su experiencia que las actividades esenciales en el manejo del contrato se cumplan, evitando notificaciones extemporรกneas y la acumulaciรณn de controversias no resueltas. Resolution processes that, although they may be Ad-Hoc, can also be administered by organizations specialized in managing these dispute resolution alternatives, such as the ICC or the Arbitration Centers of the different chambers in different countries. Four-C has extensive experience in the different types of procedures offered by these institutions.

Our participation in these processes has allowed disputes to be resolved in a timely manner, avoiding unnecessary and harmful costs and delays for the participating parties.


Conciliation

Conciliation generally arises from a clause in a construction contract by which the parties agree to attempt to resolve their dispute through direct intervention by themselves in a conciliation process. The typical clause may provide for the involvement of a third party (amiable compositeur), which is designated by agreement of the parties or by a specific institution, where Four-C could act as the conciliating entity, in which case, Four-C offers all the technical knowledge of its experts to clarify the complex situations that cause the dispute.


Mediation

It consists of the participation of a neutral third party to help the parties resolve a dispute or disputes arising from construction contracts. From this perspective, the concepts of mediation and conciliation can and in fact are considered similar by some institutions that have been in charge of regulating procedures for their application. This is how Chambers of Commerce and Business Mediation Centers around the world have their own rules under which these procedures are developed. In any case, the parties have some freedom to modify these rules and apply them to their particular process, or use an Ad-Hoc process, if both parties agree to it.

In this process, Four-C can act as a mediator or as an expert to support the mediator in resolving the complex situations that give rise to the controversy.


Expert Determinations

The independent opinions that Four-C offers under this service are useful for resolving differences or disputes on certain matters of an eminently technical nature. The service can range from issuing only our professional opinion on the matter in question, to making this opinion binding on the parties, depending on what the parties agree to in the dispute resolution procedure that they define.

As construction disputes are rarely purely technical or purely legal, expert determination processes with review of the opinion by a legal expert have proven to be highly effective.

Likewise, this service can be provided under the rules of some administrative or Ad-Hoc institution as stipulated by the parties in their agreement.


Arbitrations

In these processes where the resolution of the dispute or disputes is under the responsibility of an Arbitrator or Arbitral Tribunal, Four-C can participate either as a Party-Appointed Expert or as an Expert appointed by the Arbitrator or Tribunal.

Four-C's work in these processes is to review all existing evidence of the case in question and, with the technical expertise of its experts, analyze and determine the technical-contractual merits, the cause-and-effect relationships, and the quantum of the claims, thereby helping the Tribunal or Arbitrator make their final decision based on the facts.


Dispute Boards

 This permanent mechanism, which is typically established at the signing and commencement of the execution of a construction contract, is a very effective way of helping the parties to avoid and resolve disputes from the early stages of contract development. Four-C can participate as a member of these panels, contributing all its technical experience in project development, as well as its knowledge of industry practices applicable to each case.

When an arbitration is initiated, law firms are often confronted with a large number of documents from the execution of a project, mostly of a technical nature. By training, lawyers tend to focus primarily on legal documents and issues, even though the substance of most disputes is primarily technical.

Four-C's extensive experience in these types of processes and in infrastructure projects allows us to offer pre-evaluations of disputes from a technical-contractual point of view. With this, lawyers gain a much more complete and accurate view of the case in minimal time.

Another area where Four-C's participation can be of great help is in the professional handling of documents relevant to the case. The structure of a project's documentation is normally not oriented to the requirements of Contract Management and its potential claims. Four-C can support law firms in creating, from the universe of information accumulated in a project, a structure of supporting documentation relevant to each underlying controversy, claim, or issue. When Four-C is not involved as an expert in an arbitration, we offer to support law firms in the preparation of explanatory presentations on technical issues, the preparation of question trees for their cross-examinations, and hearing support for answers to technical questions during said examinations.
